Sen. Rand Paul Introduces Amendment to Rein in FDA Abuse

President, today I'm offering an amendment to the FDA. I'm troubled by images of armed agents raiding Amish farms and preventing them selling milk directly from the cow. I think we have bigger problems in our country than sending armed FDA agents into peaceful farmers' land and telling them they can't sell milk directly from the cow.

My amendment has three parts. First, it attempts to stop the FDA's overzealous regulations of vitamins, food and supplements by codifying the first amendment prohibition on prior restraint. What do I mean by that?

The first amendment says you can't prevent speech, even commercial speech, in advance of the speech. You can't tell cheerios that they can't say there's a health benefit to their Cheerios. Under our current FDA laws, FDA says if you want to market prune juice, you can't say that it cures constipation.

You can't make a health claim about a food supplement or about a vitamin, you can do it about a pharmaceutical, but you're not allowed to do it about a health supplement.

I think this should change. There have been several court cases that show this goes against not only the spirit but the letter of the law of the First Amendment. So this amendment would change that.

This amendment would stop the FDA from censoring claims about curative, mitigative effects of dietary supplements. It would also stop the FDA from prohibiting distribution of scientific articles and publications regarding the role of nutrients in protecting against disease.

Despite four court orders condemning the practice as a violation of the First Amendment, the FDA continues to suppress consumers' right to be informed and to make informed choices by denying them this particular information. It's time for Congress to put an end to FDA censorship.

Second, my amendment would disarm the FDA.

Now, some of you might be surprised the FDA is armed. Well, you shouldn't be.

We have nearly 40 federal agencies that are armed. I'm not against having police, I'm not against the army, the military, the FBI, but I think bureaucrats don't need to be carrying weapons and I think what we ought to do, is if there is a need for an armed policeman to be there, the FBI who are trained to do this should do it. But I don't think it's a good idea to be arming bureaucrats to go on the farm to, with arms, to stop people from selling milk from a cow.

I think we have too many armed federal agencies, and that we need to put an end to this. Criminal law seems to be increasing, increasingly is using a tool of our government bureaucracy to punish and control honest businessmen for simply attempting to make a living.

Historically the criminal law was intended to punish only the most horrible offenses that everyone agreed were inherently wrong or evil, offenses like rape, murder, theft, arson - but now we've basically federalized thousands of activities and called them crimes.

If bureaucrats need to involve the police, let's have them use the FBI, but I see no reason to have the FDA carrying weapons.

Today the criminal law is used to punish behavior such as even fishing without a permit, packaging a product incorrectly or shipping something with an improper label.

Simply said, the federal government's gone too far.

The plain language of our Constitution specifies very few federal crimes. In fact, the Constitution originally only had four federal crimes and now we have thousands of federal crimes.

We've moved beyond the original intent of the Constitution. We don't even know or have a complete list of all the federal crimes. It's estimated there are over 4,000, but no one has an exact number.

Finally, my amendment will require adequate mens rea protection. In other words, when you have a crime, you're supposed to prove the intent. People have to have intended to harm someone, it can't be an honest mistake where a businessman or woman have broken a regulation and didn't intend to harm someone. If you want to convict someone of a crime and put them in jail, it should be a mens rea requirement.

This is something we have had for hundreds of years, it comes out of our common-law tradition.

This amendment would fix this problem by strengthening the mens rea component of each of the prohibited acts and the FDA acts by including the words "knowing" and "willful" before we address and accuse someone of a crime.

This I think would give protection to folks who are guilty of inadvertently guilty of breaking a regulation and would keep from overflowing our jails. We've got plenty of violent criminals without putting people in for honest breaches of regulations. If Congress is going to criminalize conduct at the federal level as it does with the FDA act, the least it can do have is have an adequate mens rea requirement. My amendment will attempt to do this.

It's not that we won't have rules at the federal level, but the rules ought to be reasonable. We ought to allow people to market vitamins. There's no earthly reason why somebody who markets prune juice can't advertise it helps with constipation.

We've gone too far, and we've abrogated the First Amendment and what we need to do is tell the FDA that the courts have ruled that the First Amendment does apply to commercial speech and the FDA has been overstepping their bounds

SCIENTIFIC STUDY OF THE MORGELLONS CONDITION

HOW TO SUBMIT INFORMATION FOR THE PROJECT

The Institute claims the exclusive right to publish all information, materials and photographs that are submitted to this organization and these materials will not be returned.

The Carnicom Institute will conduct a scientific study for the purpose of identifying measurable characteristics of the Morgellons condition. The study will involve the systematic collection of data from individuals who demonstrate physiological characteristics representative of the Morgellons condition. This data will be compared to a control group of essentially random individuals using the same physiological measurements to identify if significant differences exist between the two groups.

Individuals that contribute to this study will demonstrate an established set of physiological criteria that to the best available knowledge are representative of the Morgellons condition in a visible fashion. These criteria include the presence of unique filaments within or on the body, a presence of skin lesions that resist healing, and the production of an oral filament sample. Individuals that participate in this study will be required to provide sufficient and ample documentation that meets the criteria listed above. Candidates for the project will be requested to provide some additional physiological information such as temperature and pH logs. It is estimated that approximately a dozen individuals will be selected to participate in this initial study.

This study will be conducted in an anonymous and confidential manner for research purposes only. There will be no medical diagnosis or individual interpretation given. The study is for scientific purposes only and the knowledge obtained will be for the public benefit. One end result will be a statistical, observational and functional health assessment based upon these sample groups.

The small BC Company Okanagan Specialty Fruits has just submitted their request to Health Canada and the Canadian Food Inspection Agency for approval of their genetically modified “non-browning” apple. Contamination from GM apples threatens the future of our apples, and the farmers who grow them.

Background

The GM “non-browning” apple is engineered to keep from going brown after being cut. This apple is designed for fast food companies and other companies that use pre-cut apples. The technology was developed in Australia and licensed by the small BC company called Okanagan Specialty Fruits.

Okanagan Specialty Fruits asked for approval in the US in March 2010 and has just asked for approval in Canada. The GM apple has not yet been approved anywhere in the world.

What do apple growers think about the GM apple?

In 2001, BC apple growers stopped the GM apple from being field tested in Canada. The federal government agricultural station in Summerland in the Okanagan valley, an important fruit growing area, was preparing to start field trials but BC growers who were concerned about contamination stopped these field trials from happening.

In September 2011 CBAN and organizations from across BC organized a series of public events to discuss genetic engineering. At an event in Keremeos, Lee McFadyen of Mariposa Organic Farm and the Live Earth Organic Growers Association pointed out that there are already several varieties of apple that don’t brown.

Orchardist Andrea Turner of the Similkameen Okanagan Organic Producers Association said, “The tree fruit industry cannot afford anything silly like that”.

NEW ECONOMIC VISIONS, SUSTAINABLE BANKING: Cooperative Banking in the Aquarian Age

According to both the Mayan and Hindu calendars, 2012 (or something very close) marks the transition from an age of darkness, violence and greed to one of enlightenment, justice, and peace.  It’s hard to see that change just yet in the events relayed in the major media, but a shift does seem to be happening behind the scenes; and this is particularly true in the once-boring world of banking.

In the dark age of Kali Yuga, money rules; and it is through banks that the moneyed interests have gotten their power.  Banking in an age of greed is fraught with usury, fraud, and gaming the system for private ends.  But there is another way to do banking, the neighborly approach of George Bailey in the classic movie “It’s a Wonderful Life.”  Rather than feeding off the community, banking can feed the community and local economy.

Today the massive too-big-to-fail banks are hardly doing George Bailey-style loans at all.  They are not interested in community lending.  They are doing their own proprietary trading—trading for their own accounts—which generally means speculating against local interests.  They engage in high-frequency program trading that creams profits off the top of stock market trades; speculation in commodities that drives up commodity prices; leveraged buyouts with borrowed money that can result in mass layoffs and factory closures; and investment in foreign companies that compete against our local companies.

We can’t do much to stop them.  They've got the power, especially at the federal level.  But we can quietly set up an alternative model, and that's what is happening on various local fronts.

Most visible are the “Move Your Money” and “Occupy Wall Street” movements.  According to the website of the Move Your Money campaign, an estimated ten million accounts have left the largest banks since 2010.  Credit unions have enjoyed a surge in business as a result.  The Credit Union National Association reported that in 2012, for the first time ever, credit union assets rose above $1 trillion.  Credit unions are non-profit, community-minded organizations with fewer fees and less fine print than the big risk-taking banks; and their patrons are not just customers but owners, sharing partnership in a cooperative business.

Move “Our” Money: The Public Bank Movement

The Move Your Money campaign has been wildly successful in mobilizing people and raising awareness of the issues, but it has not made much of a dent in the reserves of Wall Street banks, which already had $1.6 trillion sitting in reserve accounts as a result of the Fed’s second round of quantitative easing in 2010.  What might make a louder statement would be for local governments to divest their funds from Wall Street, and some local governments are now doing this.  Local governments collectively have well over a trillion dollars deposited in Wall Street banks.

A major problem with the divestment process is finding local banks large enough to take the deposits.  One proposed solution is for states, counties and cities to establish their own banks, capitalized with their own rainy day funds and funded with their own revenues as a deposit base.

Today only one state actually does this, North Dakota.  North Dakota is also the only state to have escaped the credit crisis of 2008, sporting a sizeable budget surplus every year since.  It has the lowest unemployment rate in the country, the lowest default rate on credit card debt, and no state government debt at all.  The Bank of North Dakota (BND) has an excellent credit rating and returns a hefty dividend to the state every year.

The BND model hasn’t yet been duplicated in other states, but a movement is afoot.  Since 2010, 18 states have introduced legislation of one sort or another for a state-owned bank.

Values-based Banking: Too Sustainable to Fail

Meanwhile, there is a strong movement at the local level for sustainable, “values-based” banking—conventional banks committed to responsible lending and service to the local community.  These are George Bailey-style banks, which base their decisions first and foremost on the needs of people and the environment.

One of the leaders internationally is Triodos Bank, which has local offices in the Netherlands, Belgium, the United Kingdom, Spain, and Germany.  Its website says that it makes Socially Responsible Investments that are selected according to strict sustainability criteria and overseen by an international panel of “stakeholder” representatives representing various community, environmental, and worker interest groups.  Investments include the financing of more than 1,000 organic and sustainable food production projects, more than 300 renewable energy projects, 33 fair trade agricultural exporters in 22 different countries, 85 microfinance institutions in 43 countries, and 398 cultural and arts projects.

Two U.S. banks exemplifying the model are One PacificCoast Bank and New Resource Bank. Operating in California, Oregon and Washington, One PacificCoast is comprised of a sustainable community development bank with around $300 million in assets and a non-profit foundation (One PacificCoast Foundation).  Its commercial lending business focuses on such sectors as specialty agriculture, renewable energy, green building, and low-income housing.  Foundation activities include programs to “help eliminate discrimination, encourage affordable housing, alleviate economic distress, stimulate community development and increase financial literacy.”

New Resource Bank is a California based B-corporation (“Benefit”) with $171 million in assets, which focuses its lending and banking services on local green and sustainable businesses.  New Resource was recognized in 2012 as one of the “Best for the World” businesses, being in the top 10 percent of all certified B-Corporations and scoring more than 50 percent higher than 2,000 other sustainable businesses in overall positive social and environmental impact.

All this might be good for the world, but isn’t investing locally in a values-based bank riskier and less profitable than putting your money on Wall Street?  Not according to a study commissioned by the Global Alliance for Banking on Values (GABV).  The 2012 study compared the financial profiles between 2007 and 2010 of 17 values-based banks with 27 Globally Systemically Important Financial Institutions (GSIFIs)—basically the too-big-to-fail banks, including Bank of America, JPMorgan, Barclays, Citicorp and Deutsche Bank.  According to the GABV report, values-based banks delivered higher financial returns than some of the world’s largest financial institutions, with a return on assets averaging above 0.50 percent, compared to just 0.33 percent for the GSIFIs; and returns on equity averaging 7.1 percent, compared to 6.6 percent for the GSIFIs.  They appeared to be stronger financially, with both higher levels of and better quality capital; and they were twice as likely to invest their assets in loans.

An overwhelming majority of pregnant women who visit the doctor’s office are now refusing the flu vaccine over fears it will harm their fetus. The medical community is on damage control pushing out flawed studies in an attempt to sway opinion in a losing battle for control over fetus health. More than 90% of all expecting mothers will now say no to the flu vaccine due to fear of miscarriage and delivery of toxic byproducts to their unborn child.

Getting a flu shot during pregnancy provides unanticipated risks to the baby. Specifically, one study showed that the H1N1 vaccination during the H1N1 pandemic was associated with thousands of cases of miscarriages and stillbirths which the CDC failed to inform vaccine providers.

Current data from a 3-year reporting base is confirming previous reports that the majority of pregnant women are refusing influenza and other related vaccines that may jeopardize their health and that of their baby.

In 2011, Dr. Alessandro Bertoucci who analyzed the practices of 256 physicians treating more than 600,000 patients, reported that a staggering 91% of pregnant women are declining influenza vaccines due to fears of miscarriage and suspected toxins in the vaccine itself.

A shocking report from the National Coalition of Organized Women (NCOW) presented data from two different sources demonstrating that the 2009/10 H1N1 vaccines contributed to an estimated 1,588 miscarriages and stillbirths. A corrected estimate may be as high as 3,587 cases. NCOW also highlighted the fact that the CDC falsified reports ignoring all cases related to miscarriages from the H1N1 vaccine.

Using the Vaccine Adverse Event Reporting System (VAERS), including updates as a second ascertainment source, capture-recapture statistical methods were used to estimate the true number of miscarriages and stillbirths following A-H1N1 flu vaccination in the U.S.

Typically, even so-called “complete” studies conducted by the CDC have been shown to miss from 10% to 90% of the actual cases because of under-reporting.

Pregnant women have a well-established antipathy toward vaccinations, with past averages calculating that only 15% getting the flu vaccine in any given year, compared with 30% of the general population, according to CDC reports. Moreover, pregnant women distrust medications in general — even though conventional medicine insists that flu vaccines could prevent or mitigate infection should they be exposed.

“Pregnant women have an incredibly strong maternal instinct and they will not submit their child to anything that could even possibly be of harm,” said midwife Naomi Kates.

A sizable portion of reproductive-age women in Los Angeles are not convinced of the value of any type of vaccine, said Dr. James Moran, chairman of obstetrics and gynecology at Saint John’s Health Center in Santa Monica.

Yet, despite established evidence of miscarriages, recent conflicting studies such as the recent one from Ottawa Hospital Research Institute (OHRI) and funded by the Canadian Institutes of Health Research (CIHR), showed that compared to pregnant women who were not vaccinated against H1N1, mothers who received the H1N1 vaccination were 34% less likely to have a stillbirth. The study also found no increase in adverse outcomes for H1N1-vaccinated mothers and their babies during the weeks before and just after birth.

Dr. Bertoucci stated that the study was flawed and cannot be trusted due to misrepresented data and conflict of interest. “Bernard Prigent is Vice-president and medical director of Pfizer Canada and part of the governing council of the CIHR, so perhaps you can tell me how an unbiased study can come out of the OHRI being funded by the CIHR with such an association?”

Pfizer Canada also provides unrestricted grants to the Canadian Coalition for Immunization Awareness & Promotion (CCIAP), a merger of the Canadian Immunization Awareness Program (CIAP) and the Canadian Coalition for Influenza Immunization (CCII).

Bertoucci said the study only used from Ontario’s birth record database and did not include miscarriages or even one dataset from any vaccine adverse event reporting systems which would have dramatically skewed the results of the study.

When discussing the H1N1 vaccine, Dr Chris Udenze, who works in Nottingham, said “In all the pregnant women we’ve offered it to, I think only about one in 20 has agreed.”

A GP in Kensington said he encountered “considerable skepticism” from pregnant women. And Dr Sharon Shmueli, a GP in Swindon, said fewer than 25 percent of pregnant patients at her practice had chosen to be vaccinated.

Officials typically propel pregnant women and their unborn children near the top of the priority list for vaccinations. The decision is mostly attributed by unreliable and unsubstantiated statistics which suggest that pregnant women have suffered and died from flu at disproportionately higher rates. Moreover, very little if any information from medical reports reveals and rules out other health problems in each case.
